Contract law and organised markets Stavros Kitsakis, PhD, Attorney-at-Law Abstract: Organised markets, such as exchanges, have traditionally been the subject of extensive regulation. However, contract law of organised markets has rarely been the subject of legal analysis. Based on the example of the Greek energy market the analysis is exploring the relevance of tradi- tional legal concepts of contract law for the trading structure of a specific organised market. Contract formation, contractual liability of the operator and the clearing house of the market, breach of contract in the framework ofmultilateral trading and set-off aswell as the role of a central counterparty are among the topics discussed.The discussion allows formore general con- clusions on fundamental notions of contract law and on the interrelation- ship between the latter and the general concept of regulation.
