HYDROCARBONS The legal agreements for the exploration of the offshore fields in the upstream sector Dr. Marika Karagianni, Legal and Political Expert on Energy ISBN 978-960-622-658-8 Abstract: The book contains a thorough analysis on all issues pertaining to energy development in the Caspian Sea: hydrocarbons’presentation, geological character- istics, environmental and economic data of the five coastal zones, as well as detailed documentation of the diplomatic history of the Caspian Sea, focusing on the issue of the legal status. An argumentation is made whether the Caspian is a sea or a lake together with a thorough examination of the multilateral negotiations from 1992 until August 2018, when the Aqtau Convention on the legal status of the Caspian Sea was signed. In the second part of the book, the contractual framework of hydro- carbons research and development is presented, i.e. the four legal types of offshore field development: concession, production sharing, service and joint venture. Then, the production sharing agreement is analyzed extensively, namely its operation module, the tax model, each phase of implementation as well as the way it serves the contradictory interests of the State and the foreign investing companies. Then, the analysis is focusing on the application of the production sharing agreement in offshore hydrocarbon development in Azerbaijan and Kazakhstan. Finally, the last chapter contains a comparative analysis of the application of the PSA in Azerbaijan and Kazakhstan and main conclusions are extracted regarding the use of this con- tract in different parts of the world.
