Compulsory Expropriation Restrictions to Ownership Editor: N. Rozos, Vice-President of the Hellenic Council of State h.c., Ph.D. ISBN 978-960-622-817-9 Abstract: The present edition attempts to examine, on a theoretical and jurispru- dential basis, issues relevant to the declaration, execution and revocation process of compulsory expropriation as well as the process of temporary and definitive estima- tion of the compensation owned due to the compulsory expropriation. Issues that include, inter alia, compensation and identification of its beneficiaries, the filing of a restitutory action, the limitations period of exercising the right to compensation, as well as special cases of compulsory expropriation, are analysed at separate chapters. Considerable emphasis has been placed on the case law of the Hellenic Council of State and the way that it deals with the issue of compensation. The authors have focused on the analysis of the Law 2882/2001, as construed by the case law of the Hellenic Council of State and Areios Pagos (the Hellenic Supreme Civil Court), and the way that each of these Courts has applied the Law 2882/2001 and dealt with the issues that were open to interpretation at the process of its application. The analy- sis is further complemented with reference to judgments of the European Court of Human Rights. The edition includes the text of the Law 2881/2001, as modified and updateduptothepublicationoftheLaw4530/2018 (whichwaspublishedonMarch 30, 2018 at the Issue A’, no. 59, of the Hellenic Government Gazette).
