Despite the fact that the Supreme Court upon the ap- proval of a cassation in law refers the case to the competent court, there are some cases where it shall decide on the acquittal of the accused due to violation of law (: Article 518 of the Greek Code for Criminal Procedure).The book examines the pos- sibility of the acquittal of the accused during the pretrial phase of the criminal pro- cedure, the feasibility of an acquittal of the accused not only due to false application and interpretation of law, but also due to lack of reasoning and criticizes the jurisdic- tion of the Greek Supreme Court that leads not only to the acquittal but also to the conviction of the accused.
