Privacy Law and Consumer Law Evangelos Margaritis Attorney at Law, LL.M., CIPP/E ISBN 978-960-654-116-2 Abstract: Data Subject and Consumer are at first sight subjects of two different legal systems, at the epicenter of which stand different legal values. However, this study is determined to quest for the crossroad of informational self-deter- mination on the one hand and weakest part’s protection against unfair busi- ness practices for direct marketing, as well against abusive contractual terms for granting consent to data processing, on the other hand, especially in the online environment. The study at hand, comprising the author’s postdoctoral research, deals with those issues, in individual and collective perspective, in B2C and B2B levels. Provisions arising from the data protection law are thoroughly examined under the aspect of consumer law. Ultimate purpose of this study is to forge a ro- bust and clear “consumer privacy law” applicable in cases when a natural person acts as a consumer while their data are being processed, especially for marketing purposes .
