Pro-enforcement bias in favor of recognition and enforcement of foreign arbitral awards Αccording to the NewYork Convention of 1958 Athanassios V. Skontzos Lawyer, PhD cand. - State Scholarship Foundation grant holder, LLM (Athens), LLM (HU Berlin) ISBN 978-960-654-269-5 Abstract: A modern handbook on New York’s Convention of 1958 pro-enforce- ment thrust which runs through its norms as a fundamental interpretative prin- ciple. The study seeks to review and provide interpretative and case law based analysis on the application of the New York Convention by Greek state courts that are entrusted with the difficult task of ensuring a coordinated and teleologically oriented uniform interpretation and application of its substantive rules. Method- ologically, the study is structured into two interrelated parts: Part I attempts to examine the legal basis and nature of the Convention’s pro-enforcement bias with emphasis on international scholarship and case law, as well as on the preparatory work of the Convention, where appropriate. Part II aims to present in a digestible but complete manner the Greek case-law on the interpretation and application of the Convention, with references to international jurisprudence, as part of a case- law driven comparative approach. A textbook of high academic effort, valuable for judges, lawyers and academic researchers. COPYRIGHT All rights reserved.
