6 ΚΕΦΑΛΑΙΟ 1 legal family and the courts». 32 Οι Burley και Mattli επισημαίνουν ότι η έννοια του social legitimacy θα λειτουργήσει ως «shield-mask» προστατεύοντας τη δικαστική εξουσία, αφού: “[It] hides and protects the promotion of one particular set of political objectives against con- tending objectives in the purely political sphere […] Law can only perform this dual political function to the extent it is accepted as law. A ‘legal decision’ that is ‘transparently’ political in the sense that it departs too far from the principles and methods of the law, will invite direct po- litical attack. It would thus fail both as mask and shield». 33 Στην παρούσα ανάλυση, οι βασικές κατηγορίες «συνομιλητών» αποτελούνται από το σύνολο της δι- καστικής εξουσίας, την εκτελεστική και νομοθετική εξουσία και την ευρύτερη νομική κοινότητα. Επί του ζητήματος της αναπόφευκτης διασύνδεσης της δικαστικής προσέγγισης με την πολιτική ου- δετερότητα, πρέπει να διευκρινιστεί και να τονιστεί ότι σε καμία περίπτωση δεν μπορεί η παραπάνω αναφορά να ερμηνεύεται ως να αποδίδει ή να υπονοεί διασύνδεση με την κομματική έννοια. Χρήσι- μη είναι η αναφορά του Fallon, σημαντικού μελετητή του περιεκτικότερου αμερικανικού συνταγμα- τικού παραδείγματος, που αναφέρει ότι: «the Court has ‘liberal’ and ‘conservative’ Justices who attract those labels by reaching conclu- sions that can plausibly be identified as liberal or conservative most of the time. This is a phe- nomenon that needs to be explained, not ignored, and surely not denied. At the same time, I do not believe that judicial politics are simply a concealed form of partisan electoral politics. In this book I try to explain the ways in which Supreme Court decision-making is and is not (or at least should not be) ‘political’». 34 Άρα, η αναφορά σε «πολιτικές επιλογές» εμπεριέχει την αναπόφευκτη ερμηνευτική επιλογή από την αξιακή ιεράρχηση που κάθε συνταγματικό δικαστήριο έχει στη διάθεσή του, συνεπεία της ίδιας της φύσης του δικαίου κατά την κλασσική αντίληψη του Dworkin περί hard cases και Herculian judge. 35 H προσέγγιση του Dworkin ως έκφραση του κινήματος τού νομικού ρεαλισμού, θεωρεί ότι ένα δι- καστήριο «is composed of more than legal computers, and it functions […] as an agency of the so- cial and political environment in which it is based», 36 εφόσον η δικαστική εξουσία «constitutes a kind of policy community, relatively autonomous from, but in constant interaction with, other pol- icy communities». 37 Συνεπώς, το κίνημα του νομικού ρεαλισμού αναγνωρίζει πρωτίστως ότι «courts by the very nature of their function are compelled to act as legislators» 38 και επανέρχεται με την ανάδειξη της ανάγκης οριοθέτησής της υπό τις περιστάσεις σύζευξης πολιτικής και δικαστικής αρμοδιότητας.
