The Inertia of the Legislator Theoretical approach and typology Chara Kafka PhD in Public Law, Postdoctoral researcher at the Law School of Athens, Lawyer ISBN 978-960-654-412-5 Abstract: The inertia of the legislator is based on the concept of the exclusive com- petence of the legislator and on the action of the administration after authorization, either legislative or directly from the Constitution. The clear separation of the action of these two bodies with decisive competence is determinant for the preservation of the principle of separation of functions, as well as for the maintenance of the po- litical system as representative and consequently democratic. At the same time, the delimitation of the concept of inertia and especially its systematization proves to be amethodofcheckingtheconstitutionalityoftheregulatoryactivity, butalsothe lack of a regulatory framework, when this is observed in specific fields. Finally, the estab- lishment of civil liability of the State for acts or omissions of the inactive legislator is considered crucial. COPYRIGHT All rights reserved.
