Admissibility in Administrative Judicial Proceedings Access to justice in the light of articles 20 par. 1 of the Constitution and 6 par. 1 of the ECHR Dr Ilias Kouvaras JD, Postdoctoral research fellow in law, Administrative Judge ISBN 978-960-654-410-1 Abstract: The complexity of Admissibility in Greek administrative judicial proceed- ings has taken on dimensions that are increasingly compressing Merits’ space. The study conducts a systematic review of the admissibility of administrative judicial proceedings in the light of the right to judicial protection, investigating the true regulatory scope of article 20 par. 1 of the Greek Constitution. The systematization of the logic and operation of the rules by which the provision of legal protection is organized can contribute to the formation of procedural conditions that are more functional and rational and less punitive. A general theory of admissibility could pre- ventthe instrumentalizationofproceduralrules inawaythathinderstheassessment of the merits. COPYRIGHT All rights reserved.
