Τhe Access to Justice in Environmental Matters Before the National Courts The Influence of the Aarhus Convention and the EU Law Vasiliki Karageorgou Assistant Professor, Panteion University of Social and Political Sciences ISBN 978-960-654-525-2 Abstract: Access to justice for alleged violations of the environmental legislation constitutes an effective review mechanism for the implementation of the environ- mental legislation. Rules concerning access to justice in environmental matters are adopted both at supranational (Aarhus Convention) and EU level. Furthermore, the enshrinement of the right to a fair trial and that to an effective remedy in the ECHR and the enshrinement of the right to effective judicial protection in EUCFR exert influence on the respective national legal rules. The book aims to answer the question concerning whether the influence, which the supranational and EU rules exert mainly on the national systems of administrative justice is critical, so that it may result to a certain level of“convergence”of the national procedural rules. The conclusion is that in spite of the significant influence of the supranational and EU rules on the national legal systems which have resulted in some significant chang- es, those changes are not of such an extent, so that it can be persuasively argued that a“convergence”of the respective national procedural rules is observed.
