Safouris Ph.D., Judge ISBN 978-960-654-575-7 Abstract: The European Court of Justice (ECJ), based in Luxembourg, is more con- nected, in the conscience of the legal world, with resolving technical issues of the Union's internal market.Thus, its important judicial function in the protection of hu- man rights is ignored. At the same time, the important function that the mechanism of the preliminary reference procedure can play in the adjudication of national cases (civil, criminal, administrative) where human rights are violated is almost unknown. This book aims at this very goal: to inform the legal professionals about the possi- bilities of protecting the violated human - fundamental rights offered by referring a question to the ECJ, which may be considered as the second European "human rights court", after ECtHR. It is useful for the national judge, who wishes to activate the mechanism of preliminary reference in such pending court cases, but also for the lawyer, who wishes to submit, in a correct and substantiated way, a request to a national court to refer to the ECJ, in a case where the protection of fundamental rights is at stake.
