New aspects of the legal framework of the capital controls in the context of the contemporary EU law are highlighted, while the thorough analysis gives an accurate picture for the establishment and functioning of the free movement of capital as one of the key elements in the EU internal market. Taking into account the specific characteristics of the capital restrictions, but also the recent cases of their implementation -in times of crisis- in Greece and Cyprus, it is clear that, now, their imposition is neither the usual practice, as it was for many decades in the past, nor an easy way out -from a legal point of view- for the Member States.
