Abstract:
This book consists of two parts. The first part addresses various issues
of the general theory of fundamental rights regarding their evolution and legal
nature, the right holders and obligors, the restrictions thereunto as well as is-
sues arising from concurrent application or conflict between rights. The second
part comprises a thorough analysis of the specific fundamental rights, such as
the principle of equality, personal freedom, freedom of expression, freedom of
religion, freedom of the press, institutional guarantees upon public broadcasting
services, freedom of the arts, sciences and education, the right to property, the
right to a fair trial by an independent and impartial tribunal established by law,
the right to be heard, the freedom of assembly and association and trade union
freedom. Specific reference is made to protection of family, marriage, maternity
and childhood, as well as the right to health, employment, social insurance and
access to housing. Furthermore, this edition includes a new chapter dealing with
environmental protection issues from a constitutional perspective.
