Abstract:
This volume examines various issues arising in the context of material
and territorial competence of civil courts, as well as jurisdiction in cross-border
civil and commercial matters, pursuant to the provisions of the Code of Civil
Procedure and Regulation (EU) No. 1215/2012. This book consists of two
parts. The first (general) part comprises a concise yet thorough analysis in
matters of international jurisdiction, material and territorial competence of
civil courts, pursuant to the Code of Civil Procedure, as in force following the
amendments introduced by Law No. 4335/2015. The second (special) part
addresses in detail specific cases and matters of frequent and particular interest
deriving from the Civil Code, the Code of Civil Procedure and various special
civil laws, each accompanied by useful procedural diagrams. Up-to-date and
targeted references to legal scholarship and case-law as well as a general index
of terms render this book a comprehensive and handy legal companion for those
studying or practicing in this field.
