Abstract: This book entitled “Payment services. The private law aspects of law
3862/2010” examines the private law aspects of Law 3862/2010, which im-
plemented the provisions of the Directive 2007/64/EC (PSD) on payment serv-
ices in the internal market into domestic law. The importance of the relevant
rules has significantly increased, due to the domestic legal prohibition of pay-
ments in cash which applies to a large category of transactions and the recent
enforcement of restrictions on capital movements. The amendments introduced
by the recent Directive 2015/2366/EU (PSD II) have been also taken into con-
sideration.
The book is divided in three parts: the first part examines the scope of rules’
application, the legal relations established when a payment transaction is ex-
ecuted, issues related to applicable law, the payment service provider’s obliga-
tion for information and the contract for the provision of payment services. The
second part is devoted to the stages for the execution of a payment transaction
(payment order, authorization of payment transactions and execution of pay-
ment transactions). The third part examines the payer’s liability in the case of
abusive use of payment instruments, the payment service provider’s liability in
the case of unauthorized payment transactions or non – execution or defective
execution of payment transactions, claims for refunds for payment transactions
initiated by or through the beneficiary and the right of recourse of a payment
service provider. The book contains an alphabetical index and detailed bibliog-
raphy (Greek and foreign).
