Criminal Law
Concepts and Institutions of the General Part
Alexander P. Kostaras,
Professor, University of Thrace
Abstract:
This book offers a presentation and interpretation of the various concepts and
institutions of the General Part of Criminal Law. Following an analysis of the principle of
legality (“nullum crimen, nulla poena sine lege”) – indeed a fundamental one in Criminal
Law – and an explanation of the occurrence and operation of the criminal phenomenon
and the constitutive elements thereof (legally protected right, crime, penalty) the author
underlines the purpose sought by Criminal Law and the particularities of the latter with
respect to other fields of law. Furthermore, the author presents the system of penalties of
the Greek Criminal Law and its specific rules, and offers a brief overview of the objectives
of regulating and implementing the relevant penalties and security measures, focusing
especially on the treatment of juvenile offenders under the criminal justice system. Finally,
the elements of a crime are analysed, as established under Article 14 of the Greek Penal
Code (an act which is unlawful, imputable to the offender, punishable under the law).
This edition concludes with the analysis of special forms of crime, i.e. attempt, conspiracy
and accumulation of offenses.
