– Creates the conditions for problem-solving process that will consist-
ently reflect the protection and promotion of international common
interest in the evolving administration and management of the con-
ventional regime, thus offering, within this framework, an important
tool of relational governance.
In this framework, revision as a technique of relational governance
may be exercised in three directions:
i)
Enhancing and strengthening the institutional structure
of
the conven-
tional environmental regime
(integrating all relevant actors in the de-
cision-making of the regime - improving and expanding the institu-
tional mechanism of the regime).
ii)
Managing the contextuality of the conventional regime
(determining
the relationship with the evolving intrinsic and extrinsic contexts).
iii) Managing the harmonization of the established scope of the convention-
al regime with the evolving functional requirements of this regime.
Further, the Secretariat, properly capitalizing on its institutional dual-
ity, is also well placed to secure
transparency
and function as
creative facili-
tator
during the renegotiation process by:
– Explaining the rules of procedure and using fair procedure;
– Using objective criteria for its proposals and for the expression of its
views during the negotiation;
– Explaining the tradition and the practice followed in the framework
of the treaty regime during the negotiation;
– Maintaining balance and pluralism in informal consultations with
the parties for the formulation of compromise proposals or the intro-
duction of new ideas;
– Proposing effectively and insisting only strategically.
A final point. The Ad Hoc Meetings may be greatly facilitated by the
organization of Open-Ended Ad hoc Meetings when entirely new propos-
als are submitted at the time that the draft text seems to be consolidated.
