Appeal against a decree and a judgment and weak persons

Lampros Ch. Margaritis

Professor at the Aristotle University of Thessaloniki, School of Law

Abstract:

Minors and the mentally ill constitute –naturally, biologically, and

socially– two groups of “offenders” found among the wider category of «weak»

persons. Age on the one hand and health on the other are two properties that

require the special procedural protection of their holders. This protection is not

provided, at least as far as one would expect, under Greek law. This edition

attempts to document the doctrinal problems of these two areas, to present the

existing approaches, to highlight procedural necessities and to provide solutions

especially with regard to provisions of an enhanced status.
