Solidarity in the EU legal order:

An attempt to approach a founding principle of EU law

Abstract:

Τhe present study focusses on the analysis of the mulitple legal

dimensions of solidarity and on its contribution to the formation, the

functioning and the evolution of the EU legal order. In this context, solidarity

is firstly approached at a conceptual level, since it appears in the text of the

Treaties under the triple figure of a principle, an objective and a value of the

European Union. The content of solidarity, as depicted in the primary and

secondary EU law as well as in the ECJ case law, is outlined in the second

part of the study, while the last part is devoted to the functions of solidarity

in the EU legal order, with an emphasis on its unifying, suspensive (vis-à-vis

competition/free movement rules) and social-redistributive role.
