the Hellenic Council of State

Abstract:
The concept of legitimate interest is central to the proceedings
before administrative courts, in particular in the framework of annulment
proceedings; it is considered as “the most important subjective condition of
admissibility” of the application for annulment. It constitutes a daily concern
for the court seised. The relevant case law is huge and extremely difficult to
classify. The vast majority of the 285.192 judgments of the Hellenic Council of
State that appear today in its online database deal with the issue of legitimate
interest in its various aspects. This case law has usually been consistent, but
now always. The purpose of this study is to show the evolution of the case law
of the Hellenic Council of State on this thorny issue and to facilitate readers,
to the extent possible, in identifying the specific questions of interest to them.
