Public Law of Health
Patrina Paparrigopoulou - Pechlivanidi,
Professor at the Athens School of Law
Abstract:
This book examines public law of health, i.e. a branch of public law
which includes both rules governing the organization of public health services
and rules for the respect of hygiene and safety, such as rules controlling private
and public health services and health professionals. Public law of health is cat-
egorized as a branch of social protection law, since society collectively faces
healthcare risks by creating policies to prevent or remedy damages. The book
first analyses the sources of this branch of law and emphasizes the principles
of prevention, precaution, quality of services, sustainability and cooperation,
which in the EU’s legal regime are used not only for the pillar of health but for
the environmental and consumer pillars as well. Then it analyzes the organiza-
tion of health services (in the UK, France and Greece) and the rules for the pro-
tection of the rights of the users of public health services. Finally, it examines
primary prevention and secondary prevention settings aiming at the hygiene and
security of the population in Greece. The book focuses on the hygiene and safety
of food, beverages, water and air, work and workplaces, on the protection of the
genetic material, the fetus, the maternity and the child, the protection against
contagious and non-communicable diseases, and on dependences such as drugs,
nicotine and alcohol.
