Employment of foreign citizens of EU Member States

ABSTRACT

This book aims at presenting the critical issue of the employment of foreign

citizens of EU Member States nationals in another Member State and the rel-

evant social insurance coverage. Following an overview of the principle of

non-discrimination, the author moves to analyze the issue of European citizen-

ship, along with the evolution of CJEU case law on that matter, as well as the

relationship between that concept and the concept of ‘migrant worker’ and the

social rights. This analysis is followed by a thorough illustration of the rights of

‘free movement of workers’ and of their ‘freedom to provide services’, as well

as a presentation of the institutional framework within which such services

occurred and evolved. In the second part, the author discusses European social

policy and the manifold EU interventions in the social security legislation.
