Fundamental rights and obligations of attorneys

in exercising their duty

Abstract: The book interprets the provisions of Art. 38-40 of the new Greek

Attorneys' Code, that was enacted by Law 4194/2013. The Attorney-Client

privilege is analyzed not only as an obligation of lawyers but also in reference

with many special penal Laws that seem to override it. The ban of search and

seizure against lawyers, the bans of arrest and speedy trial of lawyers and their

rights to oppose testifying in Court and to being judged by the Appellate Penal

Courts are presented under the scope of compliance with the Greek Constitution

and are not considered to be unchallenged privileges of a certain professional

elite. Finally, the Right of Lawyers to advertise is thoroughly viewed as part of

the general Right to Information and thus it is argued that it does not contradict

the traditional perception of lawyers as Officers of Court with no need or legal

right to promote themselves.
