The Possession as Unjustified Enrichment

Abstract: The present work investigates the nature of possession in the frame

of unjustified enrichment. The study analyzes the influence of the German

law in this field and attempts to highlight the solutions sought by the Greek

legislator inspired by the traditions of the Byzantine-Roman law. Given the

importance of the possession over time in private legal relationships in Greece,

is justified, on the one hand, the occupation over the said theme. On the other

hand, the current trends in transactions tending to decline the ownership over

alternative forms of utilization of financial resources confer, de lege ferenda,

on closer examination of the specific institutions of the Civil Code added

value.
