The distinctive signs
Comparative analysis with emphasis on greek and german law
Henning Voelkel
Attorney at Law, PhD
Abstract: The subject of this book are the distinctive signs that are established
through the use thereof, and their relationship to the registered trademark. In
Greek law, distinctive signs are protected under the Unfair Competition Law no.
146/1914, which was based on the German law on Unfair Competition (UWG).
In Germany, the provisions related to the distinctive signs were transferred in
1994 from the Unfair Competition Law to the Trademark Law. The objective of
this book is to answer the question whether the relevant German law on distinc-
tive signs may be an archetype for the Greek law. It is proposed in this book that
the Greek legislator should also transfer these provisions into the trademark law.
