Infringements of administrative procedural law

and the annulment of administrative decisions

Abstract:

The book examines whether breaches of administrative procedural

law should (always) lead to the annulment of administrative decisions by ad-

ministrative courts. Relative theory and jurisprudence is examined in Greek,

French and German law, as well as in European Union Law. A major issue

discussed is the question of the prevalence of substantive over procedural

administrative law. Administrative courts tend to ignore errors in administra-

tive procedure, if it emerges that the attacked decision provides the only legal

solution from the point of view of substantive law, i.e. that the breach of pro-

cedural law could not have an impact upon the administrative decision taken.
