Performance of public works contract

Laws no. 3669/2008, 4070/2012 and 4412/2016

Article-by-article analysis and case law

Christos Mitkidis

Legal Counsel of the State

Abstract:

The book at hand constitutes a presentation and an article-by-article

analysis of the law on the performance of public works contracts, according to

Law no. 3669/2008 and to the (few) differentiations introduced under Law

no. 4412/2016. It presents, in a way that is easy to understand, the obligations

of both the contracting authorities and the contractors of works, and the dis-

pute settlement process, by citing numerous examples of case law of the Court

of Justice of the European Union and of the Greek Courts, notably the Supreme

Administrative Court, the Supreme Court and the Court of Auditors, as well as

opinions of the Legal Council of the State. It constitutes a significant and useful

tool for legal professionals and technical experts working on the performance

of public works contracts.
