The principle of proportionality in labour law

Abstract: The principle of proportionality in private law and particularly in

labour law emanates from the principles of good faith and prohibition of abuse

of rights. It applies in every case of an unilateral intervention by a person on

the legal sphere of another person, without the latter being able to defend

itself against it. The principle of proportionality in labour law is applied to the

control of the restrictions of freedom of association, as well as to the control

of the exercise of the freedom of contract and the exercise of the rights of

management, termination of employment, work retention and strike.
