The criminal use of offshore companies by State officials

Abstract:

This book examines issues pertaining to the criminal use of

offshore companies by State officials as proscribed in article 8 of Statute

No. 3213/2003. The said provision has aroused renewed interest, especially

in view of its recent consecutive amendments. The book comprises seven

sections. The issues discussed include: the basic features of offshore

companies, the consecutive amendments of the provisions concerning

their criminal use, the rationale underlying the criminalization of the

said conduct, the interpretation of the elements of the pertinent offenses,

intertemporal law questions arising out of the application of the lex praevia

and lex mitior principles, as well as questions pertaining to the exercise

of criminal jurisdiction over conduct featuring essentially extraterritorial

elements. The book concludes by suggesting possible amendments to the

aforementioned provisions.
