Audiovisual production contract

This dissertation (awarded with honors by the Law School of the University of

Athens) on the “contract for the audiovisual production” offers an interpretative

analysis of article 34 of Greek Law 2121/1993 (Authors’ rights and related

rights) and a comparative analysis with French, German and English law.

Starting with a research on the meaning of the wide term “audiovisual work”

in the Authors’ Right system, the dissertation further analyses the status of

audiovisual works within the category of works created by a number of

authors. The main analysis of the dissertation focuses on the nature and

structure of the contract between the producer of audiovisual work and the

director on one hand, and on the other hand of the contracts between the

producer and all other creative contributors to the audiovisual work, such as

screen-writers, authors of dialogs, music compositors, film editors and others.

The dissertation further explains the rights and duties of the co-contractors in

three different levels: during the making of the film, at the finalization of the

production (when the assignment of the authors’ rights to the producer occurs)

and during the commercial exploitation of the film. In the last chapter, various

cases of breach of these contracts are categorized depending on whether the

breach can be considered as falling within the circle of activity of each co-

contractor while the legal consequences of such breach are dealt within the

legal framework of law 2121/1993 on Authors’ Right as well as the applicable

Greek Civil Code provisions.
