Straits Used for International Navigation

Theory and Practice in the Waters Surrounding Greece

Stavros Polydorou

Commander Hellenic Navy, PhD, MA, MSC (2)

Abstract:

This book assesses the entire legal regime of straits used for interna-

tional navigation. It provides for the systematic classification and clarification

of all matters concerning these straits which are vital to international navi-

gation and overflight, both commercial and military. It is structured around

three parts: Part I addresses the development in customary and treaty law, and

defines them. Part II examines the practice under law of peace and law of war,

and Part III places two case studies in context of the previous Parts, one con-

cerning the waters surrounding Greece, and the other concerning the Straits

of the Dardanelles, the Sea of Marmara and Bosporus, assessing the effect of

U.N.C.L.O.S. III, and the 1936 Montreux Convention on them.
